Access Offshoring recognises that your privacy is important, and we are committed to protecting the personal information we hold about you in accordance with the Privacy Act, including the APPs.
This Privacy Policy sets out how we may collect, hold, use and disclose your personal information, including the overseas disclosure of personal information to the Philippines as part of our offshoring services.
We may update this Privacy Policy from time to time by publishing the updated policy on our website.
Definitions
In this Privacy Policy, the following definitions apply:
- Access Offshoring, we, us or our means Access Offshoring Pty Ltd ACN 688 501 859;
- APPs means the Australian Privacy Principles;
- Personal Information means any information or opinion about an individual who is identified or reasonably identifiable, regardless of whether it is recorded in a material form or not;
- Privacy Act means the Privacy Act 1988 (Cth);
- Privacy Policy means this privacy policy; and
- Sensitive Information is a subset of personal information and includes information or an opinion about an individual’s racial or ethnic origin, political opinions, religious or philosophical beliefs or affiliations, membership of a political, professional or trade association or trade union, sexual orientation or practices, criminal record, health or genetic information, biometric templates, and biometric information used for verification or identification.
Collection of Personal Information
We may collect and hold your personal information if you:
- enquire about or engage our services
- are a job candidate or employee placed through our services, or are otherwise involved in an offshore staffing arrangement
- work for, represent, or are connected to a current or prospective client of our services;
- visit our website or interact with us via social media or other digital platforms;
- subscribe to or opt in to receive updates, newsletters, or marketing communications; register for or attend webinars, recruitment sessions, or company-hosted events; apply for a role with us (in Australia or the Philippines); or
- otherwise interact or deal with us in connection with our business.
We may collect your personal information directly from you or from third parties such as:
- recruitment platforms, reference providers, background check services, or former employers
- government bodies and regulatory authorities, both in Australia and the Philippines, including for visa processing or compliance;
- current or past employers, or a third party acting on your behalf (e.g. legal representative, accountant, HR advisor);
- service providers or partners, such as payroll companies, insurance brokers, or IT support vendors;
- public sources, such as company websites, social media, professional networking sites, and public registers, depending on the nature of your interaction with us.
If you provide personal information about another individual to us (e.g. as an emergency contact or referee), we ask that you refer them to this Privacy Policy. You must also ensure that you have that person’s consent, particularly if it is Sensitive Information, or that the disclosure is otherwise permitted under the Privacy Act.
Types of Personal Information Collected
The types of personal information we collect and hold about you will depend on our relationship with you and the purpose for which we are collecting the information. This may include:
- personal details such as your name, title, date of birth, gender, and contact details (e.g. email address, phone number, and residential address);
- employment-related information, such as your resume, qualifications, employment history, job title, employer, work eligibility (including visa or residency status), and referees;
- identity documentation, such as passport, driver’s licence, national ID, Tax File Number, and other government-issued identifiers
- financial information, including banking details for salary payments, superannuation details, and payroll records;
- information about your relationship with us and our clients, including placement history, performance feedback, and engagement records;
- health or Sensitive Information, including medical certificates, disclosed disabilities or health conditions (only where relevant to the role and with your consent);
- information, including Sensitive Information, collected via communications, such as emails, phone calls, interviews, online forms, or virtual meetings; and
- technical information, such as IP address, browser type, and usage data when interacting with our website or systems.
Purposes of Collection or Holding
We collect, use and disclose personal information to:
- fulfil contractual obligations with clients and employees;
- assess job applications and manage employment;
- administer payroll and employee benefits;
- comply with legal and regulatory obligations; and
- improve our services and maintain business operations.
Failure to Provide Information
When we interact or have dealings with you, we will usually need to collect some of your personal information. If we are unable to collect this information or the information you provide is incomplete or inaccurate, we may be unable to provide you with the services, information or other assistance you are seeking.
Disclosure
We may disclose personal information about you to third parties for the purposes outlined in this Privacy Policy, including to facilitate recruitment, placement, and employment services, and to operate and grow our offshoring business. These third parties may include:
- our related companies including entities based in the Philippines, for internal business operations and administrative purposes,
- our service providers who assist us in operating our business including IT and technology support providers, payroll processors, HR and recruitment partners, accounting, audit and professional advisors, banks, insurers, and compliance specialists;
- clients who engage us to provide offshoring or recruitment services, including their authorised personnel and advisers (such as HR representatives, or compliance officers);
- any third parties that you have authorised us to disclose your personal information to;
- government departments and agencies, regulatory authorities, licensing bodies, courts and tribunals, law enforcement agencies or any other person as required or authorised by law (including the Privacy Act);
- industry research groups, market survey organisations, or legal directories, for quality assurance, business benchmarking or promotional purposes;
- a purchaser of the assets and operations of our business, where those assets and operations are purchased as a going concern; and
- our related entities and other organisations who may provide you with information about our services, employment opportunities, or jointly offered events and programs (unless you opt out).
Cross-Border Disclosure
In the course of providing employment offshoring and outsourcing services, we may disclose your personal information to entities located in the Philippines. These disclosures are made to facilitate employment services, administrative support, and other business functions.
Specifically, personal information will be disclosed to Access Offshoring Philippines Inc, a related entity of ours which engages personnel to provide offshoring services to our clients.
While the entities in the Philippines may not be subject to the Privacy Act, we take reasonable steps to ensure that any overseas recipient complies with the APPs or is subject to laws or binding schemes that provide substantially similar protection to the APPs. These steps include:
- entering into binding data processing agreements;
- conducting due diligence and risk assessments; and
- applying data handling and security measures.
By providing your personal information to us, you consent to the disclosure of your personal information to overseas recipients as described in this policy.
Storage and Security
We store personal information in electronic and paper form and use third party service providers to store some personal information.
We take reasonable steps to protect your personal information that we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure, including:
- ensuring the use of secure servers and encryption;
- ensuring the use of access controls and user authentication; and implementation of Staff training and confidentiality agreements.
Access to and Correction of Personal Information
You may request access to or correction of your personal information that we hold about you, by making a written request to our Privacy Officer using the details set out in the Contact Us section below. We will respond within a reasonable time and may charge a fee for providing access (but not for making a request).
If, upon receiving access to your personal information, or at any other time, you believe the personal information we hold about you is inaccurate, incomplete or out of date, please notify us immediately. We will take reasonable steps to correct the information so that it is accurate, complete and up to date.
We may need to verify your identify before providing access to or correcting your personal information.
Complaints
If you believe we have breached the APPs or this Privacy Policy or wish to make a complaint about the way that we have handled your personal information, you may make a complaint to us at the contact details below. We will respond to your complaint within a reasonable time and take reasonable steps to investigate your complaint.
